StruxHub, Inc. (collectively, “StruxHub,” “us,” “our,” “we”) is committed to securing and protecting the privacy of the personal information of visitors to our websites. This Privacy Policy explains how we may collect, use, and share personal information from or about you on www.struxhub.com website (the “Site”), when using any of our construction management software applications (the “Service”), or through other interactions with us. This policy also describes our privacy practices and the choices you can make about the ways your information is collected, used, and shared when you access or use our Site and Service (collectively, the “Site and Service”).

This Privacy Policy describes: what information we collect; how information you provide may be used by StruxHub and third parties working on our behalf; your choices regarding the collection, use, and sharing of such information; and, the security measures that we have implemented to protect the information. StruxHub will take reasonable steps to protect user privacy consistent with the guidelines set forth in this Privacy Policy and applicable laws.

This Privacy Policy does not apply to the use of personal information by third parties whose website may be linked to our Site and Service or who otherwise independently collect information from you.

Acceptance of this Privacy Policy

By accessing the Site and Service, you agree to be bound by this Privacy Policy, including the transfer of information pertaining to you from the country where you reside to the United States and our use tracking technologies as described in this Privacy Policy. StruxHub reserves the right, at its sole discretion, to change, modify, add, or remove portions of this Privacy Policy at any time for any reason.

Each time you use the Site and Service, the current version of the Privacy Policy will apply. Accordingly, your continued use of the Site and Service following a change in the Privacy Policy represents your consent to the new Privacy Policy to the fullest extent permitted by law. We suggest that you regularly review this Privacy Policy and our Terms for changes and to ensure that you understand and accept our privacy practices and your obligations in accessing and using the Site and Service.

PERSONAL INFORMATION COLLECTED

STRUXHUB collects personal information directly from you in various ways, including when you visit or use our Site and Service, create an account with us, participate in our social media communities, and when you contact us or send us feedback. Our Service provides a collaborative mobile construction management software tool that can be used to streamline logistics coordination and schedule tracking to job sites.

The personal information we collect includes:

User profile and contact information: During the account registration process or otherwise during your use of our Site and Service, you may provide us personal information such as your name, email address, phone number, your employer and job title, and username and password.

User content: We will collect any user content you create, share, or post to the Site and Service, which may include information contained in your user account, as well as photos or other image files and associated metadata. We may collect information that you submit when you contact our customer-support team at www.struxhub.com. This may include your name, email address, phone number, and any other information submitted during your use of our Site and Service.

Other information: We may also collect information about your mobile device when you use our mobile applications or otherwise access the Site and Service from your mobile device, including the device’s unique device identifier, operating system, browser type, IP address, mobile network information, and your movement, positioning, and geo-location. Such information is generally collected to assist our users in effectively managing their workforce.

Tracking Data & Cookies: We use cookies and other online tracking technologies to understand visitor activity on our Site and Service, and to hold certain information about your visits to help improve your experience while using the Site and Service.

A cookie is a text file sent by a web server and placed on your computer by your web browser. Cookies can be divided into two different types: session and persistent. Session cookies differ from persistent cookies primarily in that session cookies are temporary and expire and are typically deleted when you close your browser. Persistent cookies, in contrast, remain stored on your computer after you close your browser until they are deleted either because they expire or you delete them.

We may use the services of certain third parties in connection with these cookies.

None of these cookies are strictly necessary to access our Site and Service. You may reset your browser to refuse all cookies or to allow your browser to alert you when a cookie is set. However, certain parts of the Site and Service may function differently and not as well and you may not be able to use some portions of our Site and Service.  Unless you have adjusted your browser setting so that it will refuse cookies, our Site and Service will issue cookies when you log on to the Site and Service.   • to respond to your requests and communicate with you about Site and Service upgrades or other account information;
  • to administer STRUXHUB’s Site and Service, systems and troubleshooting purposes;
  • to analyze the Site’s and Service’s usage and improve our products and services;
  • for new product development;
  • to send you marketing communications about StruxHub, as well as other products and services we believe may be of interest to you; and
  • to otherwise facilitate our business operations and needs and/or comply with law.

DISCLOSURE OF PERSONAL INFORMATION

Third Party Service Providers, Agents, Contractors, or Partners: We may share personal information with our third party service providers, agents, contractors, or partners in connection with services that these individuals or entities perform for, or in collaboration with StruxHub. These service providers, agents, contractors, or partners are restricted from using this data in any way other than to provide services for StruxHub or in partnership with StruxHub in servicing you.

As Required by Law or to Protect Our Rights and Interests or for the Protection of Others: We may disclose information to comply with applicable laws and regulations, such as to respond to a subpoena or similar legal process, to protect against misuse of our Site and Service, to protect or enforce our rights and interests or to protect the rights, property, or safety of other users of our Site and Service or the public, and to otherwise cooperate with law enforcement or regulatory authorities.

Business Transfers: We may transfer or share a copy of personal information about you in the event of a business reorganization or transition, such as a merger, acquisition, or the sale of all or a portion of StruxHub’s assets.

YOUR CALIFORNIA PRIVACY RIGHTS

California Shine the Light Law

California’s “Shine the Light” law permits California residents to annually request and obtain information free of charge about what personal information is disclosed to third parties for direct marketing purposes in the preceding calendar year. We do not distribute your personal information to outside parties for their direct marketing without your consent, except as provided for in this Privacy Policy.

California Consumer Privacy Act (CCPA)

The CCPA is effective as of January 1, 2020, and provides certain data privacy rights (subject to certain limitations) to California residents for the protection of Personal Information collected from or about them. These rights include the right to: (i) ask for a copy of your personal information to be provided to you; (ii) request the deletion of your personal information; and (iii) opt out of the sale of your personal information to third parties. If you are a California resident and would like to make any of the requests above, please submit your request as described below:

Request to Know About Personal Information We Collect, Use and Share & Request to Delete Personal Information

If you are a California resident covered by the CCPA, you are permitted to: (1) request that StruxHub provide details on the personal information from or about you that we collect, use, and share, and (2) request that we delete your Personal Information. You may designate a representative to make such requests on your behalf.

To facilitate your “Request to Know” or “Request to Delete,” you or your authorized designee must complete submit to StruxHub our “California Consumer CCPA Request Form” available here (https://www.struxhub.com/legal). As described on the form, once completed, it can be submitted in one of the following ways:  (1) via e-mail to the address: info@struxhub.com or (2) via postal mail to the address: StruxHub, Inc. 1517 North Point St. #514 San Francisco CA 94930, Attention: Jeffrey Chen, CEO.

After the form is submitted, StruxHub may contact you or your designee for identity verification, and may request further information to help us confirm the validity of the request.  As described on the form, StruxHub will consider various factors when deciding the steps needed to verify your identity (and also your authorization of a designee to make the request, if request is made by someone other than yourself).

Following a successful verification process, we will respond within legally-mandated timeframes (typically within forty-five (45) days). Depending on the request, our response may be to provide the information requested, or to make the requested deletion. In certain instances, our response may indicate that a legal exemption would prevent us from honoring your request (e.g., a data deletion request).

“Do Not Sell My Data”

The CCPA requires companies that sell personal information to provide California residents an:

  • “Opt-out” option: to request that the company “Do Not Sell My Data,” and
  • “Opt-in” option: for minors under 16 years of age.

StruxHub does not sell the personal information we collect and therefore we do not include these options on our Site and Service.

Discriminatory treatment

DATA SECURITY

We aim to protect Personal Information by implementing and maintaining reasonable security, such as by using reasonable organizational, technological and physical safeguards appropriate to the sensitivity of the Personal Information we hold.  We take measures to safeguard your Personal Information, but we cannot guarantee its absolute security.

JURISDICTIONAL LIMITATION

Our Site and Service are directed to residents of the United States. Residents of other countries should not use the Site and Service or submit their information via the Site and Services and Service. All personal information collected through the Site and Service will be processed in the United States consistent with United States law, and if you submit information to us on the Site and Service, you consent to the transfer and processing of your personal information in the United States.

CHILDREN’S PRIVACY

The Site and Service are not intended for children. We do not knowingly collect personal information from children under the age of 13 and in the event that we learn that a child under the age of 13 has provided information on our Site and Service, we will delete that information as soon as possible.

CHANGES TO PRIVACY POLICY

We may amend, alter, or otherwise change this Privacy Policy at our sole discretion.  The revised policy will be effective immediately upon posting to the Site and Service. We will post any changes on this page and update the “Last Updated” date. Further use of our Site and Service following the update of this Policy constitutes your acceptance of the updated Privacy Policy.
